These Terms of Service ("Terms") govern your access to and use of JulesKain.com and your purchase or use of products and services offered by Jules Kain Music ("Jules Kain Music," "JKM," "we," "us," or "our").

By accessing this website, creating an account, purchasing a product or service, booking a lesson, submitting a custom order, or otherwise using our services, you agree to these Terms.

Jules Kain Music provides music education, digital music products, custom music services, and related resources.

Our products and services may include:

Products, pricing, availability, delivery methods, and turnaround times may change from time to time.

2. Eligibility and Customer Responsibility

You must provide accurate and complete information when making a purchase, creating an account, submitting a custom order, or communicating with Jules Kain Music.

If you are under the age required to enter into a binding agreement where you live, a parent or legal guardian should make purchases or enter into agreements on your behalf.

You are responsible for maintaining the accuracy of your contact information so that we can deliver your order and communicate with you.

3. Digital Products

Most Jules Kain Music products are digital products.

Unless a product page specifically states otherwise, no physical product will be shipped.

Digital products may include PDF sheet music, MIDI files, chord charts, arrangements, lesson materials, recordings, or other downloadable or electronically delivered content.

You are responsible for providing a working email address and compatible device, software, and internet connection necessary to access digital products.

4. Digital Product License

Unless expressly stated otherwise, purchasing a Jules Kain Music digital product gives you a limited, non-exclusive, non-transferable license to use that product for your own personal, educational, musical, church, rehearsal, or performance-related use.

Purchasing a digital product does not transfer ownership of the product, arrangement, notation, file, design, instructional content, or other Jules Kain Music intellectual property to you.

Unless we provide written permission, you may not:

  • Resell our digital products

  • Redistribute purchased files

  • Upload purchased files to file-sharing websites

  • Post complete purchased files publicly online

  • Share download links publicly

  • Repackage our products for sale

  • Claim our transcription, notation, arrangement, tutorial, or educational work as your own

  • Remove Jules Kain Music branding or copyright notices for the purpose of redistribution

  • Use our products to create a competing commercial library or service

You may use legally obtained materials as reasonably necessary for your own learning, rehearsals, performances, church music preparation, and personal musical development.

If a church, school, choir, organization, or other group requires broader reproduction or distribution rights, please contact Jules Kain Music regarding appropriate permission.

5. Custom Transcription Orders

Custom transcription services involve creating musical notation or related materials based on a recording or reference supplied or identified by the customer.

The customer is responsible for providing accurate information and a suitable reference recording or link.

The scope of each transcription is determined by the product or service purchased and the information provided with the order.

A transcription may include certain elements such as:

  • Piano notation

  • Chord symbols

  • Lyrics

  • Vocal melody

  • Choir parts

  • Musical markings

  • Other requested musical information

Not every transcription product includes every item listed above. Please review the applicable product description before ordering.

Additional work outside the original scope of an order may require an additional fee.

6. Custom Tutorials

Custom piano tutorials are created based on the song, recording, or musical material identified by the customer.

The exact presentation and teaching approach may vary depending on the complexity of the music.

Tutorials are intended as educational resources and may focus on chords, voicings, progressions, piano parts, musical form, runs, fills, or other relevant musical elements.

Unless otherwise stated, delivery may occur through YouTube or another digital platform selected by Jules Kain Music.

7. Accuracy of Transcriptions and Educational Materials

Jules Kain Music places a strong emphasis on musical accuracy and carefully prepares its transcriptions, tutorials, arrangements, and educational materials.

However, music transcription involves interpretation. Recordings may contain overlapping instruments, unclear passages, improvisation, production effects, live variations, or musical information that cannot always be determined with absolute certainty.

We therefore cannot guarantee that every note, chord, voicing, lyric, articulation, or musical detail will perfectly reproduce every element of a source recording.

If you believe we have made a meaningful error in custom work, please contact us so that we can review it.

8. Revisions and Corrections

Reasonable corrections to custom work may be made when something included within the agreed scope of the original order was transcribed incorrectly.

Requests that substantially change the original instructions, reference recording, arrangement, instrumentation, key, scope, or desired output may be considered additional work and may require an additional fee.

Customers should submit correction requests within a reasonable period after receiving their completed order.

Jules Kain Music reserves the right to determine whether a request constitutes a correction or a new/additional service.

9. Turnaround Times

Any turnaround time provided by Jules Kain Music is an estimate unless we expressly guarantee a specific delivery date in writing.

Custom music work varies considerably in complexity.

An order may also enter a production queue before active work begins.

Turnaround times can be affected by factors including:

  • Current order volume

  • Musical complexity

  • Song length

  • Recording quality

  • Requested instrumentation

  • Choir or vocal complexity

  • Customer response time

  • Revision requirements

  • Technical issues

  • Holidays or unforeseen circumstances

We make reasonable efforts to complete orders within the estimated timeframe provided at the time of purchase.

Estimated turnaround times are not guaranteed deadlines unless expressly agreed to in writing.

10. Rush Orders

Where available, customers may purchase rush service for faster processing.

Rush service is subject to availability.

Purchasing rush service means that Jules Kain Music will prioritize the applicable order according to the rush service offered. It does not guarantee a particular deadline unless that deadline has been specifically confirmed by Jules Kain Music.

If you need an order for a church service, rehearsal, concert, recording session, wedding, funeral, or other time-sensitive event, please contact us before ordering when possible to confirm availability.

11. Customer-Supplied Music and Content

When submitting a recording, link, file, image, lyrics, musical work, or other material to Jules Kain Music, you represent that you are permitted to provide that material to us for the requested purpose.

You retain whatever rights you legally hold in materials you submit.

You grant Jules Kain Music permission to access and use submitted materials as reasonably necessary to complete your order, communicate with you, provide revisions, and maintain appropriate business records.

Authorized members of the Jules Kain Music team or contractors may access relevant materials when necessary to assist with transcription, notation, editing, production, quality control, or fulfillment.

12. Copyrighted Music and Third-Party Rights

Many songs requested by customers are compositions owned or controlled by third-party songwriters, publishers, record labels, artists, or other rights holders.

Jules Kain Music does not claim ownership of third-party musical compositions merely because we create educational material, a transcription, tutorial, arrangement, or other service relating to that music.

Rights in the underlying musical composition or recording remain with their respective copyright owners.

Purchasing a Jules Kain Music product or service does not grant you rights to a third-party composition, master recording, lyrics, or other copyrighted material beyond whatever rights are provided by applicable law or the relevant rights holder.

Customers are responsible for obtaining any licenses or permissions that may be required for their particular public performance, recording, publication, commercial distribution, synchronization, reproduction, or other use of copyrighted music.

13. Piano Lessons

Jules Kain Music offers private music instruction and related educational services.

Lessons may address areas such as:

  • Gospel piano

  • Music theory

  • Chords and voicings

  • Ear training

  • The number system

  • Playing in all 12 keys

  • Choir accompaniment

  • Gospel harmony

  • Repertoire

  • Improvisation

  • Musicianship

  • Church music preparation

  • Other areas relevant to the student's goals

Instruction is personalized and may vary according to the student's ability, experience, goals, learning style, and progress.

Purchasing lessons does not guarantee a particular level of musical ability, professional opportunity, employment, performance outcome, or rate of progress.

Individual results depend substantially on practice, participation, preparation, experience, and other factors outside our control.

14. Lesson Recordings

Certain Jules Kain Music lessons may be recorded for the student's personal educational use.

Unless otherwise stated, a lesson recording provided to a student is intended for that student's personal viewing and practice.

Lesson recordings may not be resold, commercially distributed, publicly uploaded, republished as a course, or otherwise commercially exploited without written permission from Jules Kain Music.

Students may retain and revisit lesson recordings made available to them subject to these Terms and any limitations of the platform used to host or deliver those recordings.

We cannot guarantee that a third-party hosting or technology platform will remain available indefinitely.

15. Scheduling, Rescheduling, and Missed Lessons

Students are responsible for attending scheduled lessons at the agreed time.

If you need to reschedule, please provide as much advance notice as reasonably possible.

Repeated missed appointments, late cancellations, or failure to attend a scheduled lesson may result in the lesson being considered used, particularly when the reserved time could not reasonably be offered to another student.

Specific lesson packages or booking pages may contain additional scheduling or cancellation conditions. Where applicable, those conditions form part of these Terms.

Jules Kain Music may reschedule a lesson when necessary due to illness, emergency, technical problems, scheduling conflicts, or other reasonable circumstances.

16. Lesson Packages and Mentorship Programs

Certain lessons, mentorship programs, or educational packages may include multiple sessions, recordings, resources, or other benefits.

The exact contents of a package are determined by the description provided when the package is purchased.

Unless expressly stated otherwise, purchasing a lesson package does not provide unlimited lessons, unlimited support, or lifetime access to Jules Kain Music services.

Access to recordings or digital resources may continue after the applicable lesson or program when specifically included with the purchased service.

17. Prices

Prices are displayed on JulesKain.com or communicated directly to the customer.

We may change prices at any time.

A price change will not ordinarily affect a completed purchase that has already been paid for, unless the customer subsequently requests additional work outside the original order.

Applicable taxes, payment-processing requirements, or other legally required charges may be added where necessary.

18. Payments

Payment is generally required before digital products are delivered or custom work begins unless Jules Kain Music agrees to different arrangements.

Payments may be processed by third-party payment processors made available through our website or ecommerce platform.

By submitting payment information, you represent that you are authorized to use the selected payment method.

19. Refunds and Digital Products

Because Jules Kain Music sells digital products and custom services, all sales are generally final once a digital product has been delivered, downloaded, accessed, or custom work has begun.

We generally do not provide refunds simply because a customer:

  • Changes their mind

  • Purchases the wrong product

  • No longer needs the music

  • Does not use the product

  • Does not download the product promptly

  • Expected a different format that was not included in the product description

  • Experiences a scheduling change after custom work has begun

However, if you receive the wrong product, cannot access a purchased file due to a problem on our end, are charged incorrectly, or believe there is a significant issue with your order, please contact us.

We will review legitimate problems and work toward an appropriate resolution.

Nothing in this section eliminates rights that cannot legally be waived under applicable consumer-protection law.

20. Custom Order Cancellations

Custom orders involve reserving production capacity and performing work specifically for an individual customer.

If you request cancellation before work begins, Jules Kain Music may review whether cancellation or account credit is appropriate.

Once work has begun, custom orders are generally non-refundable.

If substantial work has already been completed, Jules Kain Music is not required to refund the order because the customer no longer wants or needs the completed service.

21. Download and Access Responsibility

Customers should download and securely store purchased files when downloads are provided.

While we may make reasonable efforts to help customers regain access to previous purchases, we do not guarantee that every download, hosting platform, customer account, video link, or third-party delivery service will remain available indefinitely.

We recommend maintaining your own backup of downloadable products that you purchase.

22. Intellectual Property

Except for third-party materials and musical works owned by their respective rights holders, the Jules Kain Music website and original content created by Jules Kain Music are protected by applicable intellectual-property laws.

This may include:

  • Jules Kain Music branding

  • Logos

  • Website text

  • Graphics

  • Original educational materials

  • Videos

We reserve the right to correct errors, update information, modify products or services, or cancel an order when reasonably necessary.

If we cancel a paid order because we cannot provide the purchased product or service, we will provide an appropriate refund for the portion we cannot fulfill.

The availability of content hosted on YouTube is also subject to YouTube's platform rules, technology, and availability.

We cannot guarantee that a third-party platform will host particular content forever.

27. No Guarantee of Results

Our educational services are designed to help musicians learn and develop their skills.

We do not guarantee that purchasing a lesson, tutorial, course, transcription, or other resource will produce a specific musical, professional, financial, employment, church, or career outcome.

Every student's development is different.

28. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Jules Kain Music products, services, website content, and educational materials are provided on an "as available" basis without warranties beyond those expressly stated by us.

We do not guarantee uninterrupted website availability, permanent availability of third-party platforms, or error-free operation of every digital service.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Jules Kain Music will not be liable for indirect, incidental, special, consequential, or similar damages resulting from your use of our website, digital products, educational services, or third-party platforms.

To the fullest extent permitted by law, our total liability arising from a particular purchase or service will not exceed the amount you paid Jules Kain Music for the product or service giving rise to the claim.
